Rent agreement registration in India: when it is compulsory, stamp duty and process (CIVL)

Rent agreement registration decides whether your rent agreement can be relied on in court, and stamp duty decides whether it can be used as evidence at all. This guide explains when rent agreement registration is compulsory, why most agreements run for 11 months, how stamp duty is worked out, the special rules in Maharashtra, and how to register your agreement step by step.

Rent agreement registration: key points at a glance

Quick answer

Rent agreement registration is compulsory for any lease of more than one year (Registration Act, 1908, section 17). An agreement of 11 months does not have to be registered in most states, but it must still carry the correct stamp duty. In Maharashtra, every leave and licence agreement must be registered, whatever its length, and this can be done online. Stamp duty and registration fees are set by each state, so check your state’s rates before you sign.

What is rent agreement registration?

Registration means recording your signed rent agreement at the office of the Sub-Registrar under the Registration Act, 1908. The Sub-Registrar enters it in the public records and returns the original with an endorsement. Registration is done in the Sub-Registrar’s office for the area where the property is located.

Stamp duty is a separate thing. It is a tax on the document itself, paid under your state’s stamp law before or at the time of signing. Every rent agreement needs the correct stamp duty, whether or not it is registered. A registered agreement must be properly stamped first.

According to the Ministry of Housing and Urban Affairs (2022), Andhra Pradesh, Assam, Tamil Nadu and Uttar Pradesh had revised their tenancy laws along the lines of the Model Tenancy Act. In these states, the rules for written agreements and the Rent Authority apply in addition to registration and stamp duty. Check your own state’s current law, because more states may follow.

What happens if you skip rent agreement registration

  • Weak in court: a document that had to be registered but was not cannot be used to prove the lease or its terms (Registration Act, s.49). It may still be used for limited “collateral” purposes.
  • Maharashtra penalty: a landlord who does not register can be punished with up to three months’ imprisonment, a fine of up to ₹5,000, or both. In a dispute, the tenant’s version of the terms is taken as correct unless the landlord proves otherwise.
  • Stamp duty penalty: an unstamped or under-stamped agreement cannot be admitted as evidence until the missing duty and a penalty are paid (Indian Stamp Act, s.35, and state laws). The penalty can be many times the duty saved.

Why most rent agreements are for 11 months

Because a lease of less than a year does not need registration, many landlords and tenants sign an 11-month agreement and renew it. This saves the registration fee and the trip to the Sub-Registrar, and stamp duty on a short agreement is usually low. A properly stamped 11-month agreement is a valid contract and can be used as evidence.

The trade-off is less security. You must renew every year, paying fresh stamp duty each time, and neither side is tied in for long. If you want a longer, stable tenancy, a registered agreement of two to five years is the better choice. In Maharashtra, the 11-month route does not avoid registration at all.

How stamp duty on a rent agreement works

Each state sets its own stamp duty on leases, under its own Stamp Act or the Indian Stamp Act, 1899 as adapted by the state. Rates and methods differ widely. Common methods include:

  • a percentage of the total or average annual rent for the term
  • an extra amount on any premium, advance or non-refundable deposit
  • a different treatment for the refundable security deposit, which some states add to the value and others ignore
  • a fixed amount for short agreements in some states

You can pay stamp duty by buying an e-stamp certificate (through SHCIL or your state’s e-stamp portal), by using non-judicial stamp paper, or by franking at an authorised bank. The e-stamp should be bought on or before the date of signing, in the name of one of the parties.

Example: rent agreement registration in Maharashtra

In Maharashtra, stamp duty on a leave and licence agreement is 0.25% of the total rent for the term, plus any advance or non-refundable deposit. A refundable deposit is counted as notional interest of 10% a year. Registration fee is reported as ₹1,000 in municipal corporation areas and ₹500 elsewhere, plus small document handling charges.

Example: a 24-month agreement at ₹25,000 a month with a ₹5 lakh refundable deposit. Total rent is ₹6,00,000. Notional interest is 10% × ₹5,00,000 × 2 years = ₹1,00,000. Stamp duty is 0.25% of ₹7,00,000, which is ₹1,750, plus the registration fee. Always confirm the figure with the stamp duty calculator on the IGR Maharashtra website before paying.

What you need for rent agreement registration

  • the final draft of the agreement: term, rent, increase, deposit, notice period, maintenance, repairs and any lock-in
  • identity proof of the landlord and the tenant (such as Aadhaar, PAN card or passport)
  • proof of the landlord’s ownership, such as the sale deed or a recent property tax receipt
  • two witnesses with their identity proof
  • passport-size photographs, if your Sub-Registrar office asks for them
  • the stamp duty payment (e-stamp certificate) and the registration fee
  • a registered power of attorney, if someone signs on behalf of the landlord

Rent agreement registration step by step

Rent agreement registration step by step: stamp duty, signing and Sub-Registrar (CIVL)
  1. Draft the agreement. Agree all terms first and put them in writing. Use a tested format so that nothing important is missed.
  2. Check your state’s stamp duty and fee. Use your state’s registration or stamp portal, or ask the Sub-Registrar’s office.
  3. Pay stamp duty. Buy an e-stamp certificate for the right amount, on or before the date of signing.
  4. Print and sign. Print the agreement with the e-stamp. The landlord and the tenant sign every page, and two witnesses sign at the end.
  5. Book a Sub-Registrar appointment. Many states let you book a slot online. Present the agreement for rent agreement registration within four months of signing (Registration Act, s.23).
  6. Appear with IDs and pay the fee. Both parties (or their attorney) and the witnesses attend with original IDs. The office records photographs and thumb impressions and collects the fee.
  7. Collect the registered copy. Keep the registered agreement and the receipts safely. You will need them for address proof, for a deposit dispute and at the end of the tenancy.

Registering online in Maharashtra

IGR Maharashtra runs an online leave and licence service. You can prepare the agreement, pay stamp duty and fees online and complete identity checks with Aadhaar, and for many agreements you can finish the process without visiting an office. A new version, Leave and License 2.0, has been in use in Mumbai City and Mumbai Suburban since 1 May 2025. Follow the steps shown on the portal for your district.

Common mistakes to avoid

  • Thinking notarisation is registration. A notary only attests signatures. It does not replace rent agreement registration where registration is compulsory.
  • Signing for 12 months or more without registering. The agreement then cannot prove the lease in court.
  • Buying the e-stamp after signing, or for the wrong amount or in the wrong name.
  • Adding clauses that stretch the term beyond a year, such as long lock-ins or automatic renewals, without checking whether registration then becomes compulsory.
  • Paying the deposit in cash without a receipt. Pay by bank transfer and mention the amount in the agreement.
  • Ignoring Maharashtra’s rule that every leave and licence agreement must be registered.
  • Not checking ownership. Make sure the person signing is the owner or holds a valid power of attorney.

Frequently asked questions

Is rent agreement registration compulsory for 11 months?

Not under the central law in most states, because the lease is for less than a year. It is still compulsory in Maharashtra. In states with a tenancy law based on the Model Tenancy Act, the agreement must be in writing and reported to the Rent Authority. Stamp duty is payable in every case.

Is a notarised rent agreement valid?

Yes, as a contract, if it carries the correct stamp duty. Notarisation only confirms who signed it. It is not a substitute for rent agreement registration where registration is compulsory.

Who pays stamp duty on a rent agreement, the landlord or the tenant?

Whoever the agreement says. In practice the tenant often pays, or the cost is shared. In Maharashtra, the tenant pays unless the agreement says otherwise.

Can I do rent agreement registration online?

In some states, yes. Maharashtra has a full online leave and licence service. In most other states you can pay stamp duty and book an appointment online, but you must still visit the Sub-Registrar.

What is the time limit for rent agreement registration?

The agreement must be presented within four months of signing (Registration Act, s.23). If you are late, the Sub-Registrar can still accept it within a further four months on payment of a fine of up to ten times the fee (s.25).

Does a registered rent agreement give the tenant any ownership rights?

No. Registration only makes the lease official. The tenant gets the right to occupy the property for the agreed term, not ownership.

Where can I get a ready-to-use rent agreement format?

CIVL’s rent agreement format covers homes, and the commercial lease agreement covers shops and offices. Both include notes on stamp duty and rent agreement registration.

CIVL format

Draft your rent agreement the right way

Use CIVL’s rent agreement format for a home, or the commercial lease agreement for a shop or office. Moving out? Read what to do if your security deposit is not returned. Still stuck? Ask CIVL.
